What does Commercial General Liability (CGL) insurance cover?

Commercial General Liability (CGL) insurance protects your business against claims for bodily injury and property damage to a third party as a result of your operations, products or completed operations, or premises.

Understanding the scope of potential liability exposures is essential across various industries and market segments. A comprehensive policy covers various liability exposures, which may also include areas such as legal defense fees, and medical expenses, ensuring financial protection over third-party injuries or property damage caused by your business.

Commercial General Liability Coverages

Third party bodily injury or property damage sustained as a result of your business operations.

Example: A third party sustains injury while on your premises and subsequently files a lawsuit against your company for compensation as a result of negligence. Common cases include premise slip-and-fall accidents.

Third party bodily injury or property damage which may occur as a result of products or completed operations.

Example: Completing a deck renovation leads to third party bodily injury as a result of being improperly installed, leading to the client falling through the deck. The potential contractors negligence may trigger a completed operations response. In turn, product operations are common to manufacturing and retail sectors.

Losses arising from harm to a personal reputation, including allegations against defamation, false arrest and wrongful eviction, with advertising injuries in the context of libel and slander.

Example: Protects a business against claims related to personal or advertising losses arising from non-physical harm to others caused through advertising or statements.

Medical payments coverage is not intended to cover the medical expenses of someone suing the business, unlike bodily injury coverage. Instead, this coverage extension is aimed at reducing the likelihood of a lawsuit and providing voluntary coverage of goodwill such as covering the expense of a ambulance ride.

Example: A customer slips and falls on a wet floor inside a retail store resulting in minor injuries such as a sprained ankle and a few bruises. The customer doesn’t file a lawsuit, but requires immediate medical attention and incurs expenses for their treatment.

This coverage subsection is regularly included in commercial general liability policies and should be carefully considered especially for tenants. It provides protection in the event that your leased premises are damaged due to negligence in the course of your business operations.

Example: A restaurant owner rents space in a commercial building. An employee accidentally leaves a stovetop burner on, causing a small fire that damages the kitchen walls, and ceilings which are part of the landlord’s property. TLL coverage would be trigged in this instance.

Supplementary Coverages

Commercial umbrella or excess liability insurance provides additional and supplementary coverage by extending beyond typical liability limits. This type of policy coverage complements an underlying commercial general liability policy and over third party auto liability limits. Commercial umbrella or excess liability insurance steps in to cover eligible losses once the primary policy’s limit have been exhausted.

Professional Liability insurance, also known as errors and omissions (E&O) liability insurance, is a specialized coverage important for businesses offering professional services which are not limited to, but including, engineers, licensed insurance professionals, and land surveyors.

Despite businesses and individuals best efforts in these professions, errors or omissions in service delivery or operations can occur and could lead to potential losses for clients. Standard general liability insurance policies typically exclude coverage for claims arising from professional services, making professional liability insurance an important specialty coverage in addition to commercial general liability. This coverage not only provides financial protection against actual claims but also covers legal expenses incurred in defending against allegations of mistakes, negligence, and other professional errors.
